Terms and Conditions

1. General Agreement

By hiring a ball machine from MatchpointRentals, you (the “Customer”) agree to abide by these termsand conditions. This agreement outlines the rules for the use ofthe ball machine,

2. Liability Waiver

The Customer acknowledges and agrees that:

  • Use of the ball machine involves inherent risks, including but not limited to physical injury or property damage.
  • Matchpoint Rentals and associated clubs are not liable for any injuries, damages, or losses arising from the use of the ball machine.
  • The Customer assumes full responsibility for their safety and the safety of others during the hire period.

3. Care and Use

The customer agrees to use the ball machine carefully and responsibly, following the manufacturer’s instructions and guidelines. The customer will only use the ball machine for its intended purpose during the Rental Period. The ball machine is designed to be water-resistant; however, it is not waterproof. In the event of water damage, the customer acknowledges that any necessary repairs or replacement arising from water exposure
will be at their own expense. Additionally, the customer agrees to:

  • Ensure that all users of the ball machine are aware of and comply with the safety guidelines.
  • Not modify or tamper with the ball machine in any way.
  • Immediately report any malfunctions or safety concerns to Matchpoint Rentals or the hosting club.
  • Not use the ball machine in the rain or in wet conditions to prevent damage to the machine and ensure user safety.

4. Payment and Credit Card Hold

  • Matchpoint Rentals reserves the right to place a $500 hold on the Customer’s credit card at the time of booking. This hold is a security deposit and will be released upon the safe return and inspection of the ball machine.
  • The Customer agrees to pay all applicable hire fees as specified at the time of booking.

5. Customer Responsibility for Damages

  • The Customer is responsible for any damages to the ball machine that occur during the hire period, excluding normal wear and tear.
  • In the event of damage, Matchpoint Rentals will notify the Customer and provide an assessment of repair or replacement costs. These costs will be charged to the Customer’s credit card.
  • The Customer agrees to use the ball machine solely for its intended purpose and

6. Replacement of Broken Ball Machine

If the ball machinebecomes broken, damaged, or inoperable due to the negligenceor misuse of the customer, the customer agrees to pay theOwner the replacement value of $2,999 for the ball machine.The payment shall be made within 14 Business days of the dateof damage.

7. Loss of Remote Control

The customer understands that theremote control for the ball machine is an integral part of the equipment. In the event that the remote control is lost during the Rental Period, the customer agrees to pay the Owner are placement cost of $200.00 for the remote control. The payment shall be made within 14 Business days of the loss.

8. Booking and Cancellation Policy

  • All bookings must be made online or via the QR code at themachine.
  • In the event of inclement weather, including rain, that prevents the use of the ball machine, the Customer may request a refund or reschedule their booking.

9. Machine Malfunction

  • If the ball machine malfunctions during the hire period, theCustomer must cease use immediately and report the issue to Matchpoint Rentals using the contact details provided in thebooking confirmation email and texts.
  • Matchpoint Rentals will assess the issue and, if deemedappropriate, provide a refund or reschedule the hire period.

10. Prohibited Activities

The Customer agrees not to:

  • Use the ball machine for any purpose other than practicingtennis or pickleball.
  • Allow unauthorised persons to operate the ball machine.
  • Use the ball machine under the influence of alcohol or drugs.

11. Indemnification

The customer agrees to indemnify and hold the Owner harmless from any claims, damages, liabilities, and expenses arising from the customer’s use or misuse of the ball machine during the Rental Period.

12. Termination of Hire

Matchpoint Rentals reserves the rightto terminate the hire agreement immediately if the Customer violates these terms and conditions. No refunds will be provided in such cases.

13. Governing Law

This agreement is governed by the laws ofthe state or territory in which the ball machine is located.

14. Acknowledgment and Acceptance

By completing the booking process, the Customer acknowledges that they have read, understood, and agree to these terms and conditions.
